Spousal Support Awards in Oregon
How does the court determine how much spousal support to award in a divorce?
Spousal support is determined by classification. There are three types of spousal support awards:
- Transitional support.
- Compensatory support.
- Spousal Maintenance support.
Transitional support is designed to assist a party until they become self-sufficient and can re-enter a job market.
Compensatory support is designed to compensate one party who made significant contributions to the education, training and skills of the other party. The court may also award support that it believes is "just and equitable" in the circumstances.
Spousal Maintenance is often employed where a large discrepancy in income exists between the two parties or in a long-term marriage where transitional or compensatory support would not be appropriate.
How much spousal support will the court award?
